Participation and prize 

 

By participating in the competition, the participant agrees to these terms and conditions of participation.

 

The prize and the course of the competition, such as the participation period or type of prize, depend on the respective competition and are described directly there.

 

The winner will be notified promptly via the specified contact channel (e.g. the messaging system of a social network).

 

 

 

Age restriction

 

Participation is only possible from the age of 18.

Participation requires that you are resident, domiciled or permanently resident in the following countries:

Further participation criteria 

 

The following entry requirements and restrictions apply to our competition:

 

A) Submission of entries

Participation in the competition requires the submission or upload of entries in accordance with the competition announcement.

 

B) Becoming a fan or follower

Participation in the competition is only open to participants who become fans, followers or subscribers of the social media accounts mentioned in the competition announcement or of the social media accounts on which the competition is organized.

Notification of winners and prize entitlement

 

Participants may be asked to provide feedback regarding collection or otherwise claiming the prize within a reasonable period of time. 

Participants are responsible for the accuracy of the contact details provided. If winners cannot be notified due to incomplete or incorrect contact details, the claim to the prize will be forfeited.

Payment of the prize in cash or in kind, its exchange or transfer to other persons is not possible, unless otherwise stated or agreed.

Exclusion from the competition, termination and modification of the competition

In the event of a culpable breach of the conditions of participation, we are entitled to exclude the participant with immediate effect.

Naming the competition participants

​

The names of the participants may be publicly disclosed in connection with the competition or the presentation of the entries and winners by us or by third parties in online media (e.g. on websites and in social media) or in print media. Participants can object to this at any time.

Competitions within online platforms

​

If the competition takes place within an online platform or a social network (e.g. Facebook or Instagram, hereinafter referred to as "online platform"), the following provisions also apply.

Participants cannot assert any claims against the online platform that arise in connection with participation in the competition or its use. Participants acknowledge that the competition is in no way sponsored, supported or organized by the online platform or has no connection with the online platform. All information and data provided by or collected from participants as part of the competition will be provided only to us and not to the online platform. We ask that all inquiries and information regarding the competition be directed to us and not to the online platform.

If we receive participants' data from the online platform on the basis of their permission or other legal authorization, this data will only be used, stored and otherwise processed for the purposes stated in the competition (e.g. if we provide the user's email address in a competition form).

If participants are asked to enter access data, this data will be processed by the provider of the online platform. In particular, we do not receive access to the participants' passwords. In addition to these conditions of participation, the relationship between us, the participants and the online platform is determined by the terms and conditions of the respective online platform. Further information on the consent process, information on consent given and options for withdrawing consent can be found in the online platform's privacy policy.

Notes on warranty and liability

​

We would like to point out that the competition and the prize are voluntary services on our part, for which the same scope of warranty and liability does not apply as, for example, in the case of a purchase of the raffled prizes independent of the competition.

 

Legal recourse is excluded with regard to the drawing of the winners and the possible evaluation of the competition entries submitted.

Data protection information

​

The personal data collected and processed by us will be used primarily for the purposes of running the prize draws and the competition. By participating in the competition and accepting the conditions of participation, participants consent to the unrestricted use of their image rights for private and/or commercial purposes and to the disclosure to third parties in connection with the competitions and the competition. The privacy policy of www.toldys.com applies in compliance with the applicable data protection regulations.

Processing of personal data 

​

We process personal data for the proper execution and handling of the competition and in particular for sending the prize.

The profile name and, if available, the first name and surname of the respective participant are collected and stored in order to carry out the competition. 

In order to send the prize, we also collect the winner's first and last name, address, telephone number and email address and pass this data on to a shipping company commissioned by us. The data will not be passed on to third parties beyond this.

The legal basis for this processing of personal data is Art. 6 para. 1 lit. b GDPR (implementation of pre-contractual measures and fulfillment of a contract).

If we publish the first name and surname of the winner separately on our profile or fan page or announce it externally, for example in our online store, this will only be done with the prior express consent of the winner in accordance with Art. 6 para. 1 lit. a GDPR.

Storage duration

​

After the end of the competition, the personal data processed as part of the competition will be deleted no later than one month after the end of the competition, unless there is effective consent for further processing (e.g. with regard to sending the newsletter) and/or we have no legitimate interest in further storage.

Right to object

​

You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on point (e) of Article 6(1) GDPR, including profiling based on those provisions. If the personal data concerning you are processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such marketing, which includes profiling to the extent that it is related to such direct marketing.

You have the right to withdraw your consent at any time.

You have the right to request confirmation as to whether the data in question is being processed and to request information about this data as well as further information and a copy of the data in accordance with the legal requirements.

In accordance with the statutory provisions, you also have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of personal data relating to you infringes the GDPR.
